SHIPPING & DELIVERY POLICY

We deliver products Australia wide using Handycrew (Winnings Group). All shipping and delivery costs within Australia are included within the purchase price of your Spirit Falcon Distributions product.

Australian orders are dispatched within 5 business days. Shipping times are estimated at between 5 and 10 business days depending on your location.

Note that all Australian deliveries include unboxing product and placement in desired location/room should this be required by the customer.

We also deliver products to New Zealand. All shipping and delivery costs within New Zealand are influenced by the size and weight of the product and your location. Exact shipping costs are calculated in the shopping cart and will be added to the order total before checkout.

New Zealand orders are dispatched within 5 business days. Shipping times are estimated at between 10 and 15 business days depending on your location.

 

WARRANTY

IMPORTANT: BY USING YOUR SPIRIT FALCON DISTRIBUTIONS PRODUCT YOU ARE AGREEING TO BE BOUND BY THE TERMS OF SPIRIT FALCON DISTRIBUTIONS ONE (1) YEAR LIMITED WARRANTY (“WARRANTY”) AS SET OUT BELOW. DO NOT USE YOUR PRODUCT UNTIL YOU HAVE READ THE TERMS OF THE WARRANTY. IF YOU DO NOT AGREE TO THE TERMS OF THE WARRANTY, DO NOT USE THE PRODUCT AND RETURN IT WITHIN THE RETURN PERIOD STATED SPIRIT FALCON DISTRIBUTION’S RETURN POLICY.

HOW CONSUMER LAW RELATES TO THIS WARRANTY

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE (OR BY COUNTRY OR PROVINCE). OTHER THAN AS PERMITTED BY LAW, SPIRIT FALCON DISTRIBUTION DOES NOT EXCLUDE, LIMIT OR SUSPEND OTHER RIGHTS YOU MAY HAVE, INCLUDING THOSE THAT MAY ARISE FROM THE NONCONFORMITY OF A SALES CONTRACT. FOR A FULL UNDERSTANDING OF YOUR RIGHTS YOU SHOULD CONSULT THE LAWS OF YOUR COUNTRY, PROVINCE OR STATE.

WARRANTY LIMITATIONS SUBJECT TO CONSUMER LAW

TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. SPIRIT FALCON DISTRIBUTION DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, SPIRIT FALCON DISTRIBUTION LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT SPIRIT FALCON DISTRIBUTION’S OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED BELOW. SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY (OR CONDITION) MAY LAST, SO THE LIMITATION DESCRIBED ABOVE MAY NOT APPLY TO YOU.

WHAT IS COVERED BY THIS WARRANTY?

Spirit Falcon Distributions Pty Ltd 35 Margaret Street, Cottesloe WA 6011 (“Spirit Falcon Distributions”) warrants the Spirit Falcon-branded product and accessories contained in the original packaging (“Spirit Falcon Distributions Product”) against defects in materials and workmanship when used normally in accordance with Spirit Falcon Distributions published guidelines for a period of ONE (1) YEAR from the date of original retail purchase by the end-user purchaser (“Warranty Period”). Spirit Falcon Distribution’s published guidelines include but are not limited to information contained in technical specifications, user manuals and service communications.

WHAT IS NOT COVERED BY THIS WARRANTY?

This Warranty does not apply to any non-Spirit Falcon Distributions branded products or any software, even if packaged or sold with Spirit Falcon Distributions products. Manufacturers, suppliers, or publishers, other than Spirit Falcon Distributions, may provide their own warranties to you – please contact them for further information. Software distributed by Spirit Falcon Distributions with or without the Spirit Falcon Distributions brand (including, but not limited to system software) is not covered by this Warranty. Please refer to the licensing agreement accompanying the software for details of your rights with respect to its use. Spirit Falcon Distributions does not warrant that the operation of the Spirit Falcon Distributions Product will be uninterrupted or error-free. Spirit Falcon Distributions is not responsible for damage arising from failure to follow instructions relating to the Spirit Falcon Distributions Product’s use. This Warranty does not apply: (a) to consumable parts, such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic; (c) to damage caused by use with another product; (d) to damage caused by accident, abuse, misuse, liquid contact, fire, earthquake or other external cause; (e) to damage caused by operating the Spirit Falcon Distributions product outside Spirit Falcon Distribution’s published guidelines; (f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of Spirit Falcon Distributions or a Spirit Falcon Distributions Authorized Service Provider (“SLSP”); (g) to a Spirit Falcon Distributions product that has been modified to alter functionality or capability without the written permission of Spirit Falcon Distributions; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the Spirit Falcon Product, or (i) if any serial number has been removed or defaced from the Spirit Falcon Distributions Product.

IMPORTANT RESTRICTION FOR SPIRIT FALCON DISTRIBUTIONS SERVICE.

Spirit Falcon Distributions may restrict warranty service to the country where Spirit Falcon Distributions or its Authorized Distributors originally sold the device.

 

YOUR RESPONSIBILITIES

YOU SHOULD MAKE PERIODIC CHECKUPS OF YOUR SPIRIT FALCON DISTRIBUTIONS PRODUCT AS A PRECAUTION AGAINST POSSIBLE OPERATIONAL FAILURES.

You must have the controller connected or synced to your WIFI system in order to receive warning messages from our backup systems.

Before receiving warranty service, Spirit Falcon Distributions or its agents may require that you furnish proof of purchase details, respond to questions designed to assist with diagnosing potential issues and follow Spirit Falcon Distributions procedures for obtaining warranty service. Before submitting your Spirit Falcon Distributions product for warranty service you should remove all personal information that you want to protect.

DURING WARRANTY SERVICE SPIRIT FALCON DISTRIBUTIONS AND ITS AGENTS ARE NOT RESPONSIBLE FOR ANY LOSS OF SOFTWARE PROGRAMS, DATA OR OTHER PRODUCT ON ANY PART OF THE SPIRIT FALCON DISTRIBUTIONS PRODUCT SERVICED.

Following warranty service your Spirit Falcon Distributions Product or a replacement device will be returned to you as your Spirit Falcon Distributions Product was configured when originally purchased, subject to applicable updates. Spirit Falcon Distributions may install system software updates as part of warranty service that will prevent the Spirit Falcon Distributions Product from reverting to an earlier version of the system software. Third party applications installed on the Spirit Falcon Distributions Product may not be compatible or work with the Spirit Falcon Distributions Product as a result of the system software update. You will be responsible for reinstalling all other software programs, data and information. Recovery and reinstallation of other software programs, data and information are not covered under this Warranty.

Important: Do not open the Spirit Falcon Distributions Product. Opening the Spirit Falcon Product Distributions may cause damage that is not covered by this Warranty. Only Spirit Falcon Distributions or an SLSP should perform service on this Spirit Falcon Distributions Product.

WHAT WILL SPIRIT FALCON DISTRIBUTIONS DO IN THE EVENT THE WARRANTY IS BREACHED?

If during the Warranty Period you submit a valid claim to Spirit Falcon Distributions or an SLSP, Spirit Falcon Distributions will, at its option, (i) repair the Spirit Falcon Distributions Product using new or previously used parts that are equivalent to new in performance and reliability, (ii) replace the Spirit Falcon Distributions Product with a device that is at least functionally equivalent to the Spirit Falcon Distributions Product and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or (iii) exchange the Spirit Falcon Distributions Product for a refund of your purchase price.

Spirit Falcon Distributions may request that you replace certain user-installable parts or Spirit Falcon Distributions Products. A replacement part or Spirit Falcon Distributions Product, including a user-installable part that has been installed in accordance with instructions provided by Spirit Falcon Distributions, assumes the remaining term of the Warranty or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you. When a Spirit Falcon Distributions Product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes Spirit Falcon’s Distributions property.

HOW TO OBTAIN WARRANTY SERVICE?

Please access and review the online help resources described below before seeking warranty service. If the Spirit Falcon Distributions Product is still not functioning properly after making use of these resources, please contact a Spirit Falcon representative or, if applicable, a Spirit Falcon Distributions owned retail store (“Spirit Falcon Distributions Retail”) or SLSP, using the information provided below. A Spirit Falcon Distributions representative or SLSP will help determine whether your Spirit Falcon Distributions Product requires service and, if it does, will inform you how Spirit Falcon Distributions will provide it. When contacting Spirit Falcon Distributions via telephone, other charges may apply depending on your location.

Online information with details on obtaining warranty service is provided below.

WARRANTY SERVICE OPTIONS

Spirit Falcon Distributions will provide warranty service through one or more of the following options:

(i) Carry-in service. You may return your Spirit Falcon Distributions Product to a Spirit Falcon Distributions Retail or SLSP location offering carry-in service. Service will be performed at the location. Once you are notified that service is complete, you will promptly retrieve the Spirit Falcon Distributions Product from the Spirit Falcon Distributions Retail or SLSP location.

(ii) Mail-in service. If your Spirit Falcon Distributions Product requires mail-in service, Spirit Falcon Distributions will send you information where to send your Spirit Falcon Distributions Product. Once service is complete, Spirit Falcon Distributions will return the Spirit Falcon Distributions Product to you. Spirit Falcon Distributions does not cover shipping to and from your location.

(iii) Do-it-yourself (DIY) parts service. DIY parts service allows you to service your own Spirit Falcon Distributions Product. If DIY parts service is available in the circumstances, the following process will apply.

(a) Service where Spirit Falcon Distributions requires return of the replaced Spirit Falcon Distributions Product or part. Spirit Falcon may require a credit card authorization as security for the retail price of the replacement Spirit Falcon Distributions Product or part and applicable shipping costs. If you are unable to provide credit card authorization, DIY parts service may not be available to you and Spirit Falcon Distributions will offer alternative arrangements for service. Spirit Falcon Distributions will ship a replacement Spirit Falcon Distributions Product or part to you with installation instructions, if applicable, and any requirements for the return of the replaced Spirit Falcon Distributions Product or part. If you follow the instructions, Spirit Falcon Distributions will cancel the credit card authorisation, so you will not be charged for the Spirit Falcon Distributions Product or part. If you fail to return the replaced Spirit Falcon Distributions Product or part as instructed or return a replaced Spirit Falcon Distributions Product or part that is ineligible for service, Spirit Falcon Distributions will charge your credit card for the authorized amount.

(b) Service where Spirit Falcon Distributions does not require return of the replaced Spirit Falcon Distributions Product or part. Spirit Falcon Distributions will ship you free of charge a replacement Spirit Falcon Distributions Product or part accompanied by instructions on installation, if applicable, and any requirements for the disposal of the replaced Spirit Falcon Distributions Product or part.

(c) Spirit Falcon Distributions is not responsible for any labor costs you incur relating to DIY parts service. Should you require further assistance, contact Spirit Falcon Distributions at support@steaklocker.com.au.

Spirit Falcon Distributions reserves the right to change the method by which Spirit Falcon Distributions may provide warranty service to you, and your Spirit Falcon Distributions Product’s eligibility to receive a particular method of service. Service will be limited to the options available in the country where service is requested. Service options, parts availability and response times may vary according to country. You may be responsible for shipping and handling charges if the Spirit Falcon Distributions Product cannot be serviced in the country it is in. If you seek service in a country that is not the original country of purchase, you will comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges. Where international service is available, Spirit Falcon Distributions may repair or replace Spirit Falcon Distributions Products and parts with comparable Spirit Falcon Distributions Product and parts that comply with local standards.

LIMITATION OF LIABILITY

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPIRIT FALCON DISTRIBUTIONS IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH THE SPIRIT FALCON DISTRIBUTIONS PRODUCT OR ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION STORED ON THE SPIRIT FALCON PRODUCT.

THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLIGENT ACTS AND/OR OMISSIONS. SPIRIT FALCON DISTRIBUTIONS DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY SPIRIT FALCON PRODUCT UNDER THIS WARRANTY OR REPLACE THE SPIRIT FALCON DISTRIBUTIONS PRODUCT WITHOUT RISK TO OR LOSS OF INFORMATION STORED IN THE SPIRIT FALCON DISTRIBUTIONS PRODUCT.

SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

PRIVACY

Spirit Falcon Distributions will maintain and use customer information in accordance with the Spirit Falcon Distributions Customer Privacy Policy.

GENERAL

No Spirit Falcon Distributions reseller, agent, or employee is authorised to make any modification, extension, or addition to this Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired. This Warranty is governed by and construed under the laws of the country in which the Spirit Falcon Distributions Product purchase took place. Spirit Falcon Distributions or its successor in title is the warrantor under this Warranty.

Pre-Ordering Steak Locker Devices

  1. When you pre-order a Steak Locker Device, you agree to pay any amounts and fees we may charge you for the Steak Locker Device (which may vary from a deposit to payment of the full purchase price of the Steak Locker Device). Before you are required to make any payment, you will have an opportunity to review and accept the amount that you will be charged to you. All payments are in AUD$ Dollars. We will charge the payment method you specify at the time of payment. You hereby authorise us to charge all sums described herein to such payment method. If you make any applicable payment with a credit card, we may seek pre-authorisation of your credit card account prior to your purchase to verify that the credit card is valid and has the necessary funds or credit available to cover your purchase.
  2. You agree that we may cancel or refund your payment amount at any time prior to the date on which we ship the Steak Locker Device(s) for any reason, and if we do so, we are not required to fulfill your pre-order.
  3. If you cancel your pre-order any time 30 days prior to the time we ship the Steak Locker Device(s), we will refund to you the amounts that you paid. After the 30 days window has lapsed and before the Steak Locker Device has shipped, we will refund 75% of the deposit. After the Steak Locker Device has shipped, we have no obligation to provide refunds or credits, but we may grant them in extenuating circumstances, as a result of specific refund guarantee promotions, or to correct any errors made by us, in each case in our sole discretion.
  4. Our fees are net of any applicable Sales Tax. If the Steak Locker Device(s) are subject to Sales Tax in any jurisdiction and you have not remitted the applicable Sales Tax to us, you will be responsible for the payment of such Sales Tax and any related penalties or interest to the relevant tax authority and you will indemnify us for any liability or expense we may incur in connection with such Sales Tax. Upon our request, you will provide us with official receipts issued by the appropriate taxing authority, or other such evidence that you have paid all applicable taxes. For purposes of this section, “Sales Tax” shall mean any sales or use tax, and any other tax measured by sales proceeds, that we are permitted to pass to customers that is the functional equivalent of a sales tax where the applicable taxing jurisdiction does not otherwise impose a sales or use tax.
  5. When you pre-order a Steak Locker Device, you acknowledge that the design and specifications of the Steak Locker Device, and the Services, may be altered by us prior to final delivery. If such changes are made, you will be notified in accordance with our standard practices and have an opportunity to cancel your pre-order in accordance with these Terms. You acknowledge that termination of your pre-order shall be your only means of recourse in the event of such changes in design and specification of the Steak Locker Device and/or Services.

RETURNS

PRE-ORDERS. All pre-orders are final sales and are not covered under the return policy. Pre-orders are especially discounted orders that are reliant on first delivery from manufacturer. This can be delayed for up to 90 – 120 days. All pre-ordered Steak Locker Units incur a 25% restocking fee (retained) if cancelled due to the nature of the item and the pre-order process and value.

Our return policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Downloadable software products

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted: (if applicable)

Any item not in its original condition, is damaged or missing parts for reasons not due to our error.

Any item that is returned more than 30 days after delivery

REFUNDS (IF APPLICABLE)

Pre-Orders are final sales and are exempt from refunds. Please see above.

Spirit Falcon Distributions accept returns (with the exception of Crowdfunding Backers – Kickstarter and Indiegogo) for items within the first 30 days of receiving your product. You may return it for a prompt merchandise exchange, credit, or refund within 30 days of receiving your order as long as all merchandise is returned in new condition (unused and in original factory condition), with all original boxes (including all packaging materials), documentation, instructions, and accessories. All returns are subject to our inspection and approval. Personalised and custom items, and shipping and handling charges are non-refundable, and return shipping charges are the sole responsibility of the purchaser.

To return an item for a refund or exchange, simply contact our Customer Service Department to initiate a return. You may email us at support@steaklocker.com.au. Once you obtain your return instructions, you have 15 days in which to get the product back to us. You are responsible for arranging the return shipment of the product. We reserve the right to deny a full refund of the purchase price if the product is not returned in this manner. Items that are returned may incur a 15% restocking fee. If damaged or without proper packaging materials the fee will rise to 30%. For all returns and cancellations that “shipped free” a shipping charge equal to the cost of the round trip of the shipment will be withheld from the refund. It is important to save all packaging and not destroy boxes in case of a return.

Please Note: For all damage, wrong items, missing items or defects, please contact customer service right away for return or replacement instructions.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)

If you haven’t received a refund, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted.

SALE ITEMS (IF APPLICABLE)

Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

EXCHANGES (IF APPLICABLE)

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at support@steaklocker.com.au.

GIFTS

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he or she will find out about your return.

Shipping

To return your product, you should email support@steaklocker.com.au to coordinate your return.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

When shipping return items, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
